Administrative Receivership

This procedure is effective for debenture holders who created their charge prior to 27th March 2006 in Northern Ireland.

If the company breaches the terms of its borrowings from a qualifying floating charge holder, then the creditor is entitled to appoint an Administrative Receiver to recover its debts. The receiver will take control of the company’s assets so that they can be realised for the benefit of the charge holder – any surplus assets left after the completion of the receivership are returned to the company.
